How to File an Immigrant Petition for a Spouse
If you are an American citizen filing a petition for your spouse, you will need the following (Note: Some forms require Adobe Reader for viewing. Click here to download this software for free.):
- Completed Form I-130 [PDF - 50kb] Petition for Alien Relative.
- Completed Form G-325 A Biographic Information for the petitioner.
- Completed Form G-325 A Biographic Information for your spouse.
- Proof of the petitioner's U.S. citizenship (passport valid for at least five years at time of issuance, and naturalization certificate, or birth certificate, if born in the U.S.).
- Your spouse's proof of citizenship and identity,
- Your spouse's birth certificate
- Your marriage decree issued by the Tunisian government (religious documents are insufficient evidence of relationship),
- Proof of termination of any prior marriages.
- One small (passport-style) photograph of you.
- One of your spouse.
- The petition-filing fee of $185, payable in cash. Your spouse must come with you to fill out additional forms at the time you file the petition.
- No appointment is required to file a petition with the American Embassy in Tunis.
The Embassy will not accept a petition if the petitioner has returned to the United States at any time since the marriage occurred. Such petitioners should file with BCIS in the United States.
The Embassy cannot accept any petition in which one or both spouses are under the age of eighteen (18).
