    • On February 25, 2011, the President issued Executive Order 13566 imposing comprehensive sanctions on the Government of Libya.  The Executive Order directed an immediate freeze of all assets of Colonel Muammar Qadhafi and four members of his immediate family, the Libyan Government, any Libyan state-owned companies, and the Central Bank of Libya, that are in the possession of U.S. persons, including banks, wherever located.  The Executive Order further authorized the Treasury Department to designate additional senior government officials, those responsible for human rights abuses related to political repression in Libya, and other supporters of the Qadhafi regime. 

      In September, the United States published two general licenses authorizing a broad range of commercial activity with Libya. 

      • General License 8A authorizes all transactions involving the Government of Libya, its agencies, instrumentalities, and controlled entities, and the Central Bank of Libya, provided that the transactions do not involve the individuals or entities listed in the annex to General License 8A.  This authorization includes transactions with the sovereign wealth funds and the Housing and Infrastructure Board.  Note that General License 8A keeps blocked all funds, including cash, securities, bank accounts, and investment accounts, and precious metals that were previously blocked.

      • There is additional flexibility with respect to the Libyan National Oil Company (NOC).  In addition to authorizing transactions with the NOC and entities owned or controlled by the NOC, General License 7A unblocks all property and interests in property of the NOC and entities owned or controlled by the NOC.

    What restrictions has the Special Federal Aviation Regulation (SFAR) placed in Libya?

    • The Special Federal Aviation Regulation (SFAR) prohibiting U.S. civilian flights over Libya took effect March 23, 2011.  It prohibits flights in the Libya Flight Information Region (FIR) by U.S. air carriers, U.S. commercial operators, and operators of U.S.-registered civil aircraft, or anyone flying on a U.S. airman certificate unless operating as a foreign air carrier.  The SFAR allows exceptions for U.S. government departments or agencies that make a special request to the FAA based on “a critical need to engage any person covered under SFAR 112, 91.1603(a)” to transport civilian or military passengers or cargo.
